Houby v Praze, s.r.o., Korunní 2569/108, Prague 10100 (hereinafter referred to as the "Seller") is the operator of an online shop focused on the sale of mushrooms and related products. The following terms and conditions govern the rights and obligations between the Seller and the Buyer.

 

1. General provisions
1.1 These general terms and conditions (hereinafter referred to as "Terms and Conditions") apply to all contracts concluded via the e-shop between the Seller and the Buyer.

1.2 The Buyer may be a consumer or a business. If the Buyer is a consumer, relations not regulated by these Terms and Conditions are governed by the relevant provisions of the Civil Code (No. 89/2012 Coll.) and the Consumer Protection Act (No. 634/1992 Coll.).

1.3 These Terms and Conditions are publicly available on the Seller's website and apply to all orders placed through the e-shop.

 

2. Order and conclusion of the purchase contract
2.1 The Purchase Contract shall be formed between the Buyer and the Seller by the Buyer sending the order and the Seller accepting it. The order shall be deemed to have been accepted at the moment when the Seller confirms receipt to the Buyer by e-mail.

2.2 All information about the Goods, including their description, price (including VAT and excluding VAT), is provided on the Seller's website and on the order form.

2.3 The Buyer shall provide correct and complete details when placing an order. The Seller shall not be liable for any errors resulting from the provision of incorrect data.

2.4 The Seller reserves the right to refuse an order, particularly in the event of stock being out of stock or incorrect details of the goods on the website.

 

3. Price and method of payment
3.1 The price of the goods is inclusive of VAT and other charges, unless expressly stated otherwise. The price does not include delivery costs unless otherwise stated.

3.2 The Buyer may pay the price of the Goods:

- by transfer to the Seller's bank account,

- by online payment through the payment gateway XXX.

3.3 The tax document (invoice) is sent to the Buyer electronically after completion of the order and payment of the price.

 

4. Delivery terms
4.1 The Seller delivers the goods to the address specified by the Buyer in the order.

4.2 The delivery time is usually within 5 working days of the order confirmation, unless otherwise stated. In the event of a delay, the Buyer will be informed.

4.3 Shipping costs are specified on the order form before the order is placed.

 

5. Withdrawal from the contract
5.1 The Buyer has the right to withdraw from the contract within 14 days of receipt of the goods without giving any reason, if the Buyer is a consumer.

In order to exercise the right of withdrawal, the Buyer is obliged to contact the Seller at info.uzrostou@gmail.com and send a completed withdrawal form, which can be downloaded from the Seller's website.

5.3 The Goods must be returned undamaged, in their original packaging and without signs of use. The costs of returning the goods shall be borne by the Buyer.

 

6. Complaints
6.1 Claims for defective goods are governed by the relevant provisions of the Civil Code.

6.2 The Buyer is obliged to notify the Seller of the complaint by e-mail to info.uzrostou@gmail.com and attach a description of the defect and proof of purchase.

6.3 The Seller shall settle the complaint without undue delay, but no later than within 30 days of its submission.

 

7. Protection of personal data
7.1 The Seller processes the Buyer's personal data in accordance with the legal regulations and the privacy policy available on the website.

7.2 The Buyer consents to the processing of personal data for the purpose of processing the order and sending marketing offers, if any.

 

8. Final provisions
8.1 These terms and conditions shall come into force and effect on [insert date].

8.2 The Seller reserves the right to modify the Terms and Conditions at any time. The revised Terms will be published on the Website and will apply from the date of publication.
